This brief discusses burdens of brood for whistleblower plaintiffs under 42 U.S.C. § 42141(b) of the Sarbanes-Oxley Act (“SOX”) and why plaintiffs are not required to carry the burden of proof of a defendant’s motive or intent for a retaliation claim.
