District of South Carolina: U.S. ex rel. Uppi, LLC v. Cardinal Health, Inc. et al. (D.S.C. Feb. 12, 2025)
This brief discusses the history and constitutionality of the qui tam provision of the False Claims Act, arguing its role in protecting public interest and highlighting that all three branches of government have approved of the qui tam over two hundred years of its history. It also discusses how the structure of the FCA, which provides the Executive Branch extensive control over qui tams, does not usurp Executive Power or violate the Vesting, Take Care, and Appointments Clauses.
