Patient Support Group as Kickback Scheme

United Therapeutics Corporation (UT), a seller of pulmonary arterial hypertension drugs, has agreed to pay $210 million to settle False Claims Act allegations that it paid kickbacks to Medicare patients through a purportedly independent 501(c)(3) charitable foundation, which reimbursed patients for prescription copayments.

The Anti-Kickback Statute prohibits drug companies from paying remuneration of any kind — directly or indirectly — to induce Medicare patients to purchase the companies’ drugs.
