It's Not Free Speech When You're Paid
The 4th U.S. Circuit Court of Appeals has rejected a claim by the American Civil Liberties Union that argued that the seal provisions of the False Claims Act violate the First Amendment. The court noted that whistleblower are free to talk about “the underlying fraud,” they just can’t mention they’ve filed a False Claims Act action and also expect to get a whistleblower award. The plaintiffs in this case could not name a single whistleblower who wanted to break the seal on their own case, and so the court also rejected this claim for lack of standing.
