Does Cephalon Have a Fentora Problem?
The U.S. Postal Service and the Philadelphia U.S. Attorneys’ office have sent Cephalon a subpoena for documents regarding Fentora, a highly addictive opioid painkiller similar to Actiq, another drug made by Cephalon for which the company paid $425 million under the FCA for off-label marketing.  Actiq and Fentora are only approved for cancer pain, and it's a good guess that this new  investigation is also about off-label marketing. >> To read more

Is an Ohio FCA on the Horizon?
Ohio Attorney General Mike DeWine says he wants Ohio to have its own False Claims Act,  noting that if it did, the state would get 10 percent more money when federal False Claims Act cases are settled. DeWine notes that whistle-blower protections in state FCA laws encourage individuals to come forward to report fraud to the government.  "It's a system that works in over 20 states and works at the federal level."  So far, 27 states and the District of Columbia have similar laws.
