GSA: Where Best Price is Not a Good Price
In Federal Computer Week, Steve Kelman notes that "GSA seeks prices from vendors that are equal to the best price a vendor gives 'under similar terms and conditions.' However, since the schedules guarantee no sales and constitute no buying commitment, this 'best' price is generally the best price for a quantity of one -- essentially, the best retail price around. DePuy Ortho In Trouble Again
The FDA has sent a warning letter, to DePuy Orthopaedics (a unit of Johnson & Johnson) informing them that they are illegally off-label marketing the Corail Hip System, and that they are illegally marketing and selling the TruMatch Personalized Solution System, which has never been FDA approved.
Judges Question DoJ's Low Settlements
In the past, judges have more-or-less rubber- stamped settlements worked out by the Department of Justice and defendants. In recent months, however, some judges have begun to question if DoJ is settling too low, especially when it comes to financial institutions. Judge Ellen Segal Huvelle refused to endorse a settlement between DoJ and Citigroup, while Judge Emmet G. Sullivan has raised questions about a settlement with Barclays, and Judge Jed S. Rakoff has balked at going easy on Bank of America. >> To read more
Dominion & Marathon Oil to Pay $6.9 Million
Dominion Oklahoma Texas Exploration & Production Inc. and Marathon Oil Company have agreed to pay the United States $2,219,974.98 and $4,697,476.57, respectively, to settle two false claims act cases charging the companies with knowingly underpaying royalties owed on natural gas produced from federal and Indian lands. >> To read more.
