The state of Missouri is proposing nearly $120 million in Medicaid cuts which would eliminate coverage for more than 40,000 people. Advocates for the Missouri Budget Project note that the state is putting core health care programs on the chopping block even as it winks at wide-spread health care fraud. They estimate the state could reduce Medicaid spending by 10 percent -- about $200 million -- by rooting out overcharging, false billing and other fraud perpetrated by medical providers, but that Missouri state legislators have refused to pass a state version of the federal False Claims Act.
DoJ Has to Play to Have a Say
DoJ wants to move a case Caremark filed against TennCare to Texas in order to consolidate it with a qui tam action it hasn't joined after 6 years of investigation. Confused? So was U.S. Magistrate Judge Joe Brown who expressed skepticism with the logic: ''If you're gonna transfer something to Texas and you've been having it under advisement for six years, I wouldn't hold my breath it's going to get transferred". >> To read more
Real Money and Fake Research
An egregious case of faked scientific research was settled for single damages. From 1992 to 2000, Eric T. Poehlman received $2.9 million in federal research funding based on fabricated data. During the trial the U.S. Attorney said Poehlman "destroyed electronic evidence presented false testimony, presented false documents, and influenced other witnesses to provide false documents." >> To read more
Grassley Seeks Fraud Data
Sen. Charles Grassley (R-IA) has introduced legislation that would require the Department of Justice to submit reports about fraud settlements under the False Claims Act. Notes TAF Education Fund President Jim Moorman, "We support Sen. Grassley. We don't have accurate FCA data from the DoJ on settlements. We don't even know what percentage was recovered of the money stolen in the very cases that were settled." >> To read more
NJ Hospital Settles For $1.4 M
The University of Medicine and Dentistry of New Jersey has agreed to pay $1.4 million to settle claims it billed Medicare at doctor rates when the work was really performed by interns. This case is one of 22 cases of fraud committed by Physicians at Teaching Hospitals (PATH). >> To read more
