Supreme Court Gets Briefs
in Allison Engine Case
Amicus briefs in support of the relators in the Allison Engine case before the Supreme Court have been filed by the Solicitor General’s Office, Sen. Charles Grassley and Taxpayers Against Fraud. The amici build off the arguments raised in the Relator-Respondents’ brief and offer the Court a number of policy considerations for rejecting the so-called Totten “presentment requirement.” Additional ammunition is offered in amici briefs filed by Professor Joel Hesch and relators in pending Fourth and Fifth Circuit cases. On the opposite side of the fence, representing the company charged with defrauding America's taxpayers, is this brief which asks the Court to reverse the Sixth Circuit’s decision.
New Jersey False Claims Act Signed Into Law
It's not often that both the New Jersey Senate and Assembly give a unanimous vote in support of a piece of legislation, but that's what happened with the New Jersey False Claims Act (PDF), which has now been signed into law by Governor John Corzine. Other states with FCA's include: CA, DE, FL, GA, HI, IL, IN, LA, MA, MI, MN, NH, NY, NV, OK, TN, TX, VA and Washington, D.C. >> For a complete list
Louisiana Hospital to Pay
$1.9 Million for Heart Fraud
Lafayette General Medical Center has agreed to pay $1.9 million to settle charges it defrauded federal and state health plans by billing for unnecessary cardiology procedures. >> To read more
Apollo to Pay $282 Million
A federal jury has ruled that the Apollo Group, the for-profit owner of the University of Phoenix, has to pay shareholders over $280 million for fraudulently withholding from investors the fact that a U.S. Department of Education report had concluded the school was paying recruiters to bring in unqualified students to keep enrollment numbers high. The facts underlying the Dept. of Education report are part of a False Claims Act case expected to go to trial in 2009. >> To read more
Illinois Expands Its FCA
Illinois has just expanded its False Claims Act to include fraud against Counties and other local government units. Since 2002, Illinois Attorney General Lisa Madigan has used the Illinois False Claims Act to return more than $45 million stolen from state government. >> To read more
Pharma Trinkets to Cameroon
SMDC Health Systems, a Duluth-based operator of hospitals and clinics, has decided to join the growing movement to ban gifts to doctors. As part of that initiative, it has bundled up 18,718 items (most from pharmaceutical companies) and is sending them to the west African nation of Cameroon. >> To read more
