DoJ Joins
Suit Against Lockheed
The U.S. Department
of Justice has joined a False Claims Act lawsuit against Lockheed Martin
and TMI which alleges the company overcharged the Dept. of
Defense by millions of dollars between 1998 and 2006. The
President of TMI is already in jail for defrauding DoD out
of $20 million by inflating the price of tooling used by Lockheed Martin to manufacture the F-16 and F-22

The Biggest
FCA Case Ever?
Cynthia Fitzgerald's case against Novation,
a massive Group Purchasing Organization, may be the biggest
FCA case ever. The question is whether the
U.S. Department of Justice actually has the
resources to tackle it. With more than a dozen large
companies involved, DoJ's small Civil Division is in the
same position as a small-town sheriff up against an army of

Peter Rost Gets a Second Chance
The First
Circuit has remanded Peter Rost's case against
Pharmacia/Pfizer for
reconsideration. The issue is now whether Dr. Rost can amend his complaint to plead
with greater particularity. The court
ruled that a self-disclosure made only to a government agency
is not
a “public disclosure” under the False Claims Act.

Second Stryker
Settlement:
This One for $16.5 Million

Corp. has agreed to pay $16.6 million to
settle the second FCA lawsuit in as many
months. The last settlement dealt with
massive kickbacks to doctors. this
settlement deals with double-billing
Medicare and other government health care
